Abstract

Argument for a review of the common law framework governing police entry into homes with the consent of the occupier - recognition of a sui generic public law of police trespass – the issue should be one of privacy and autonomy rather than title and ownership – balance between rights and duties – conclusion that entry by consent should be placed on a statutory footing, allowing it to be regulated by the Police and Criminal Evidence Act.
