Abstract

Deepfakes are the name given to photographic images which are altered using deep machine learning technologies - a portmanteau of “deep learning” and “fake” reflecting their use in falsifying aspects of the image. Whilst deepfake images take many forms, one of the more pronounced uses of the technology has been for the production of intimate images featuring individuals who have not consented for their images to be used for this purpose. Deepfakes have therefore been seen as the latest in a range of image based abusive behaviours which include what has previously been termed “revenge pornography”. Although a relatively recent phenomenon, broadly emerging from 2017 onwards, there has been a range of legal responses attempted in recent years including both national and multi-national legislation and attempted regulation.
