Abstract

In England and Wales, the law of torts is a complex and nuanced area of private law built upon an extensive history of common law, occasional statutory intervention, and evolving social and political perspectives on rights, responsibility and risktaking. The law of torts overlaps and interacts with numerous other areas of substantive law. This text aims to provide an introduction to the law of torts, providing a foundation for further study, application and critical evaluation of this area. It situates the law both in a theoretical context, highlighting long-standing debates over the role of tort and potential areas of law reform, and a practical context, incorporating reflective problem-based questions and beginning with a discussion of tort in the context of the civil litigation system of England and Wales. This text is the product of several years of teaching tort law at London South Bank University and I would like to take the opportunity to thank many different colleagues, past and present, for their support in various guises. In particular, I would like to thank Tracy Aquino, who led tort law when I arrived and whose modules provide the heritage for my own; David Birchall, who led undergraduate tort for several years and provided a sounding board for my equivalent postgraduate module at the time; and Abiodun Olatokun and Judith Onwubiko, who at various times contributed to the delivery of the postgraduate and, latterly, undergraduate modules I’ve been fortunate to be allowed to develop. Students on the latter in 2024-25 received lectures based, in part, on early drafts of particular chapters from this text and I’m grateful to them for questions and queries which helped to develop the text. I’d also like to express my thanks to the author of Dispute Resolution, James Corbin and the author and editor of The Law of Tort, Glenn Roberts and Paula Benn, published by CILEX, whose texts were a useful reference point during the early stages of developing this text, as well as to Edward Stone and colleagues at CILEX for asking and supporting me to do so. I hope that this text is useful and informative. I have attempted to state the law as of 2 April 2025. I welcome constructive comments, feedback or other suggestions via email to gilesc4@lsbu.ac.uk.
